Legal bases
Data for your purchase, delivery, return or requested quotation is necessary to perform a contract or prepare one at your request. Invoice and tax information is processed to comply with legal obligations. For security, misuse prevention and answering other business enquiries, By Benice relies on its legitimate interest in providing a secure and accessible service, taking your privacy into account. Where consent is required, for example for future marketing cookies, it will be requested in advance and you may withdraw it.
Provide only the information needed for an order or enquiry. Without necessary order or delivery information, By Benice cannot fulfil the order.
Who data is shared with
Data is shared only as necessary: with TransIP for web and email hosting, WooPayments/Stripe and the chosen payment method for payments and fraud prevention, PostNL for delivery, and administrative service providers or competent authorities where needed to meet legal obligations. By Benice does not sell your personal data.
Where service providers process data on behalf of By Benice, appropriate processing agreements must apply. Payment providers, banks and social platforms may also act as independent controllers for their own services and determine their applicable privacy terms. More information: TransIP, Automattic, Stripe and PostNL.
Social media and data outside the EEA
This website contains links to social platforms. When you follow a link or contact us through WhatsApp, the platform also processes data under its own privacy notice. Service providers may process data outside the European Economic Area. Transfers must rely on a valid GDPR mechanism, such as an adequacy decision or standard contractual clauses, with additional safeguards where needed. Contact support@bybenice.com to ask which transfers and safeguards apply to your situation.
Retention
By Benice retains data no longer than necessary for the purpose for which it was collected. Core financial records and invoices are generally retained for seven years to meet tax record-keeping requirements. Enquiry information is retained for handling the enquiry and as long as reasonably needed for follow-up or to substantiate agreements. If a complaint or legal dispute is ongoing, relevant information may be retained as long as needed to resolve it. An erasure request does not result in the deletion of information that must legally be retained.
Your rights
You may request access to, correction or erasure of your personal data. Depending on the circumstances, you may also request restriction or portability and object to processing based on a legitimate interest. You may withdraw consent without affecting the lawfulness of earlier processing.
Send your request to support@bybenice.com. By Benice normally responds to privacy requests within one month. If a lawful extension is necessary, you will be informed within that month. Appropriate identity verification may be requested only where necessary; do not send an unsolicited copy of your identity document. You may lodge a complaint with the Dutch Data Protection Authority.
Cookies and similar technologies
The webshop uses functional technologies for your basket, session, login, checkout and security. These are necessary for the requested functionality. For example, WooCommerce can recognise your basket and session; WordPress uses login cookies for authentication and preferences. The payment provider may use necessary technologies to secure payments and prevent fraud.
Tracking or marketing that requires consent must offer a free and specific choice beforehand. Continuing to browse does not constitute consent. By Benice does not use Google Analytics in its current setup. If marketing or analytics tools are added later, this notice and any consent settings will be updated accordingly.
You can view and delete cookies through your browser. Blocking necessary cookies may disrupt the basket, login or checkout.
Changes
The date at the top indicates when this notice was updated. If the use of data changes substantially, the information will be updated and consent requested again where necessary.
